Transaction on the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including undischarged insolvents, etc., are not eligible to use the Platform.
If you are a minor i.e., under the age of 18 years, you may use the Platform or access content on the Platform only under the supervision and prior consent/permission of a parent or legal guardian. As a minor, if you wish to transact on the Platform, such transaction may be made by your legal guardian or parents.
KIMEESH reserves the right to terminate your membership and/or refuse to provide you with access to the Platform if it is brought to KIMEESH's notice or if it is discovered that You are under the age of 18 years and transacting on the Platform.
If You use the Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password.
You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Platform and refuse to provide You with access to the Platform.
Your mobile phone number and/or email address is treated as Your primary identifier on the Platform. It is your responsibility to ensure that Your mobile phone number and your email address are up to date on the Platform at all times. You agree to notify Us promptly if your mobile phone number or email address changes by updating the same on the Platform through a one-time password verification.
You agree to: (a) ensure that You successfully log out from Your account at the end of each session; and (b) immediately notify KIMEESH of any unauthorized use of Your account.
When You use the Platform or send emails or other data, information or communication to us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email, SMS, WhatsApp, or by such other mode of communication, electronic or otherwise.
The Platform enables buyers to purchase products from KIMEESH. KIMEESH is the seller of all products on the Platform, unless otherwise specified.
Placement of an order by a buyer on the Platform is an offer to purchase the product(s). KIMEESH reserves the right to accept or cancel any such order at its sole discretion. In case of cancellation, any transaction price paid by the buyer shall be refunded.
KIMEESH makes reasonable efforts to display accurate product information including descriptions, prices, and images. However, KIMEESH does not warrant that product descriptions or other content on the Platform are accurate, complete, reliable, current, or error-free.
All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.

Products that are customized or personalized according to your specifications (including engraved items, custom hampers, printed products) are made especially for you. Please review all personalization details carefully before placing your order. Customized products are not eligible for return or exchange unless they are defective or damaged upon delivery.
All content on the Platform including text, graphics, logos, images, audio clips, video clips, and software is the property of KIMEESH or its content suppliers and is protected by Indian and international copyright laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any content from the Platform without the prior written consent of KIMEESH.
KIMEESH, the KIMEESH logo, and all related trademarks are the property of KIMEESH Gift Store.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIMEESH SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE PLATFORM OR PURCHASE OF PRODUCTS, EVEN IF KIMEESH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
KIMEESH'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO KIMEESH FOR THE PRODUCT GIVING RISE TO THE CLAIM.
You shall indemnify and hold harmless KIMEESH, its owner, affiliates, subsidiaries, group companies, and their respective officers, directors, agents, and employees from any claim or demand, or actions including reasonable attorneys' fees, made by any third party due to or arising out of Your breach of these Terms of Use, Privacy Policy, or Your violation of any law, rules or regulations or the rights of a third party.
THE PLATFORM, ALL MATERIALS, PRODUCTS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE ARE PROVIDED ON "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY REPRESENTATION OR WARRANTIES, EXPRESS OR IMPLIED.

KIMEESH shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from events beyond its reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, strikes, lockouts, pandemics, government actions, or failure of internet service providers.
KIMEESH reserves the right to terminate or suspend your account and access to the Platform at its sole discretion, without notice, for conduct that KIMEESH believes violates these Terms of Use or is harmful to other users, KIMEESH, or third parties, or for any other reason.
These Terms of Use shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Sirsa, Haryana.
KIMEESH reserves the right to modify these Terms of Use at any time without prior notice. Changes will be effective immediately upon posting on the Platform. Your continued use of the Platform following the posting of changes constitutes your acceptance of those changes.
If any provision of these Terms is found to be invalid, void, or unenforceable, that provision shall be considered severable from the remaining provisions, and the remaining provisions shall be given full force and effect.
